qcom cant assume patents will save the day because a competitor will often make decisions on a cost-benefit analysis. That is, if Ericson or others believe they have a good faith work around and the market is huge, the benefit may be in infringing the patents, making the money, and paying the damages later. This cost-benefit analysis can be just as important( if not more important) as a determination on whether they infringe one or more patents.
