I think that the very first day the "evil" company attempts to extract the first dollar of revenues from a customer, the "good" company goes to court and gets a restraining order (or whatever it would be called in these circumstances).

(Note, I am just more or less talking off the top of my head, and incorporating some of what Gregg Powers said a few hundred posts back. But, it seems like this is one area of "the law" where clear-cut "bad guys" will obviously appear to be "in the wrong.")
