i read the notice, and the rule and then called the compliance officer at one of the brokers that i use.

He assured me that they are in full compliance with the rules and that boxed positions or hedges are totally legal as long as you don't short on a down tick.
The trading firm is responsible for making sure that the down tick rule is obeyed.
the biggest advantage of a box or hedged position is the ability to short thin or illiquid stocks.
