Lawsuits mean practically nothing in the scheme of things. But in the absence of information a lot of investors would rather 'play it safe.' Personally, I don't blame them.

Pure speculation on my part, but I don't see a chance this merger going through. Institutions and board members who control most of the stock have watched their stock fall from 93 to the fifties. With all the negativity surrounding Ciena, they would be foolish to further compound the problems already created. They will say no to the merger, and look out for their shareholders.
