Dave - We are in complete, if general, agreement although as with many patent issues it often turns on definitions.

PS No need to send me the case law. I've seen it, although I have a lousy memory for details (as opposed to general landscapes) and couldn't remember any specifics - even where I'd seen it. In case it isn't obvious, I do work, of a sort (a hobby really), in this area (philosophy of IP law).

It would appear that you are fairly knowlegeable in the Legal arts. That being the case I am sure that it wouldn't be all that hard for you to do a boolean patent search and look up the exact patents in question (QCOM and CDMA). I have in the past skimmed them and I saw no language that would limit them to IS-95. I however have very, very, little if any skill in legal stuff.
