Andersen Consulting sued for non-compliant system installed in 1991!

J. Baker Inc., a large apparel retailer, is demanding that Andersen Consulting reimburse it for the cost of a computer system installed nearly 10 years ago because the system is expected to malfunction in the year 2000, officials at the consulting firm said Friday.

To try to ward off a possible lawsuit by J. Baker, Andersen asked a Massachusetts court on Friday to rule that the consultants had met all their contractual obligations when they installed the merchandising system for the retailer. The installation was completed in 1991.

The case is significant because it is one of the first that tries to blame consultants or computer vendors for installing a system that will not recognize dates after Dec. 31, 1999 -- the Y2K problem. If such a suit succeeded, it could expose Andersen Consulting, the world's largest consulting firm, as well as dozens of other consultants and computer companies to billions of dollars in liability.
