My guess is that INCY ends up cross licensing patents with AFFX. INCY might even end up paying some licensing fees in addition to cross licensing. Synteni has patents that AFFX wants and vice versa. Now that the situation is a bit clearer, I think INCY will belly up to the table and be willing to deal with AFFX. I doubt it goes to a court solution. Roy hates to fatten the attorneys with long drawn out disputes. INCY is a licensing company to boot that's their bread and butter, and it is only fair that they sometimes have to be the buyer. ''In light of the licensing program we have initiated, and the licenses we have already signed to allow others to have freedom to operate in the spotted DNA array field, it is unfortunate that Incyte has chosen to ignore Affymetrix' rights.'' >>>>> Makes me think that Fodor is really disappointed that INCY hasn't licensed the technology like everyone else, but my guess is that INCY wasn't in any hurry to license until they saw what the PTO had to say. Well, the PTO has spoken, INCY is scaling up the Synteni GEM chips and has customers who want them. My bet is that this is resolved sooner rather than later and everybody wins. After all, this is Silicon Valley, home of the win-win deal. Rman
