AHM, these are opinion boards. That which is posted here is opinion. It would have to be proved that Wexler's allegations specifically damaged TAVA, and that he knew for a fact that TAVA is not a fraud. The burden of proof is not on Bill.

BTW, we've already had this conversation, and I'm kind of tired of summer repeats. I'd suggest you review the thread around August 18 or 19. Start with this post: Message 5543485

<<Mr. Wexler has never submitted facts to support his claims of fraud on the part of Tava and its management. >>

So? This is an opinion thread, not a court of law. In order for TAVA to sue Bill, TAVA, not Bill, would have to prove that Bill spoke untruths about them, and the only way for them to do that will be to prove that they are not a fraud. Only after they make out such a case would the burden of proof shift to Bill to show that in fact TAVA is a fraud.

If you think TAVA is going to lay out their entire world for Bill to take discovery to determine whether they are/were a fraud, you are delusional.
