Barb, you are right, this is deja vu all over again. I think it's really the discovery aspect that would discourage even a meritorious case from going forward, as a lawsuit would give a defendant full access to virtually every document in the company to determine if anything it ever said was fraudulent. Discovery isn't limited by a relevancy standard, it is much broader.
