Of the requirements for maintaining a class action, one is referred to as "adequacy of representation." One element of the multi-factor test for adequacy is whether the interest of the named party is coextensive with the interests of the other members of the class. I'm not advising anyone to do anything or to not do anything. All I'm saying is don't hold out a lot of hope that someone friendly to the company can replace Lerach's plaintiffs. Judges will not allow a case to be defeated that way. This case will be settled, anyway-- most are. No, I have no expertise in strike suits particularly or in securities law generally.
