Chaz, Based on the North American GSM Alliance's response to the Senate Resolution (posted previously on the thread), the story seems genuine. As for understanding Ericy's strategy, it seems to me they are desperately searching for a way to preserve their tdma/gsm franchise, and are willing to engage in just about any kind of shameful act to do so. Their conduct vis-a-vis Qualcomm and cdma is something I have never witnessed before in companies of this size. One of the things I put a lot of weight on in evaluating a buy candidate is management's integrity and whether or not they are open and straightforward in their dealings with shareholders, employees, customers, etc. Business cultures that tolerate dishonesty will sooner or later get what they (and their shareholders) deserve. I say this because doing business with someone, regardless of contractual legalities, almost always involves large elements of trust and good faith. If I am one of Ericy's customers and see that SOB lying his butt off about QCOM's IPR (which MY lawyers confirmed the validity of last week), how am I gonna feel the next time he is across the negotiating table from me? One thing is certain - this little drama (comedy or tragedy?) will someday make one heck of a case study for future generations of B-school students. Have a nice weekend everyone.
