Dwight, I am quite sure that the congressional amendment passed, and I have seen many vultures going the "state" route. That does not mean that the vultures cannot sue in federal courts, but the "barriers to entry" have been raised substantially. Those "safe harbor" statements you see with each news release are the result of the amendment, it covers almost everything but outright fraud, cooking of books or "wonton" misstatements. All "changes in market conditions" (which is really what they blame CYMI for) is covered by the new amendment, as far as I know.
