Because if you're looking at the nem's in this example, the ask is 3 1/4. That's what you have to pay to buy. 2 7/8 is if you're selling. So you may or may not get executed depending on whether the price moves down. (or the MM is in a generous mood.<g>)

Perhaps it hasn't hit the boards yet, or there was a seller at 3 and you just "matched up".
