From the point that Tellabs started receiving "due diligence" information on Ciena, i.e. customers, cash, technology info, and current relationships of Ciena salespeople to potential customers, where they are in the sales cycle, who has approached them regarding buying more CIENA equipment, technology agreements with Cisco (i.e the details of the joint venture), etc. etc., from this point on, Tellabs is an insider. Insiders are precluded from trading on material information.
