A wild hair: Has anyone ever compared the price behavior of target companies after the suits are filed with the price behavior of similar sector companies not sued? Just wondering, given that (1) a preponderance of these suits are settled; (2) settling companies must have some cash; (3) companies that have done well since the filing of the suit are likely to have more cash for a settlement and may have lower tolerance for distractions from their main mission; and (4) the shiny-suit lawyers know (1)-(3).
Is there any chance that being sued is actually a positive indicator for future performance?
