Don't forget, he lives there. If they had gone to a bedroom, it still would have been in a building that you "own". Do you think that you have a right to investigate the sex lives of all the students who live in the dormitories of the state universities in your state, for example? As for the employee part, if there is any evidence that he used his authority to coerce her into the affair, I am not aware of it. In fact, I believe her testimony indicates that she got the ball rolling by saying, "I have a crush on you."

And oh, by the way, I have seen at least one employee handbook of a large corporation which says that if employees get into an intimate relationship who are in a direct reporting relationship, one of them will be transferred, so that they are no longer in a direct reporting relationship. In fact, that is exactly what was eventually done in Monica's case.
