Kern (John Kern's statement): I really didn't rob the bank. The partial court transcript (below) proves that. I was under oath, same as everybody else, and I didn't lie under oath. I was legally accurate, and I certainly did not volunteer information, but, even though I admit I may have done something which was wrong, I did not rob the bank. First, let me say that I am sorry that you have all been put through this ordeal, concocted by an overzealous prosecutor. I am sure that, once you have seen all the evidence, you will conclude that I am not lying when I say I did not rob the bank. Transcript: (Prosecution) Q: Mr. Kern, did you rob the bank? (John Kern) A: No, I did not. Q: Do you deny that, on the morning in question, you entered the bank, where you did not have an account, and against which you held no negotiable draft? That you passed a note to the teller? That the teller, upon reading your note, put a large sum of money in a canvas bag which you carried? That you then left the bank, and headed for the hills? A: Under the Fifth Amendment, I need not answer; but I do not deny any of that. Q: Is the person who appears in these surveillance videos, is he, in fact, you? A: Yes, he is. Q: Let me ask you again, Mr. Kern, did you rob the bank? A: I did not rob the bank. Q: So, if the teller were to testify under oath that you were the one who robbed the bank, she would be lying? A: She would not be telling the truth. (Narrator): Obviously, this was going nowhere. Let us ask Mr. Kern's lawyer for an explanation. (Mr. Kern's lawyer): The term, "rob the bank," is not legally accurate. One cannot "rob" a thing. Only a person can be robbed. So, technically, a bank cannot be "robbed." Secondly, when one views the videos of the crime, one sees an overly eager teller rushing about, loading bundles of currency into a sack, which she then forces back on a surprised Mr. Kern. If anyone was, she was the aggressor in this escapade. Mr. Kern had virtually no choice in the matter. He had to accept the gift from the teller: people were already upset, the customers had to get on with the business of banking, and the teller was adamant in her insistence that Mr. Kern take the money, and go. What was he to do at that point? Furthermore, since the teller is female and Mr. Kern is male, what this whole tawdry mess boils down to is sex. Should Mr. Kern be forced to spend years in prison because of a sex act with a consenting adult? Did Mr. Kern do anything that others would not have done, if the circumstances had been forced on them? Should Mr. Kern be forced to pay for the sins of all men? He has asked for forgiveness. Let us give it to him.
