Clark, you're right but I don't know if they are violating the spec or not. Besides causing unnecessary noise in the system they are probably reducing their battery life (talk/standby time) as well. The statement "more connection thru more bandwidth" is simply not true here. The signal is wider because of ACP(intermodulation) but ACP does not contribute to demodulation and from a system point of view is a waste of resources and is detrimental. A manufacturer who does this might be skirting the hairy edge and gaining some advantage in connectivity(at times) but to the detriment of the network and it's users, as others have pointed out. W.
