"Perhaps the short sales being kicked out of the system automatically applies to short sale market orders."

No, one was a limit and 1 was a market order.

"As for your limit short sale order receiving the same treatment, if 23 1/2 was a down tick"

No, that order was "killed". The two above were 'timed out'. Different explanation. The 23 1/2 limit was definitely when 23 1/2 was an uptick.

"And since there is no time priority on the Nasdaq and short sales receive low priority anyway, nothing is lost."

It was a daytrade, and the stock went straight down to 22 7/8. I find it hard to reconcile that as a non loss. But I can accept it because it doesn't happen often, and because Datek has loaned me all sorts of hard to borrow securities.

I guess I just think that Datek shouldn't have a problem explaining these things.
