Sheila, the uptick rule is different on the Nasdaq and the NYSE. On the Nasdaq one may sell a stock short as long as the sale occurs 1/16 over the inside bid if that is on a down tick. If TEST is trading at 10 x 10 1/4, and downticks to 9 3/4 x 10, you may offer to sell shares at 9 13/16. Your order will become the inside offer. It also requires someone to choose to take your offer, which is why it's not very effective during severe downdrafts.
