hha, well here is another inexpert thought, as i am on a roll it seems.
if one were to believe McKelvie misapplied extrinsic evidence
and the jury instructions were incomplete so as to mislead the jury
and permit an incorrect finding...

then the circuit may well accord to the lower court
finding little deference using Michel's voluntary
standard. they would have to throw it out.
