you cannot short that which is not allowed to be borrowed. i don't care where you are from. If your broker is a degenerate that wishes to breach his fiduciary relationship with you, and ARB the stock, then he may well let you short an uptick, and let you borrow from his newly "acquired" inventory. i don't work for the SEC.
