Recently Datek partially filled one of my buy orders. I wrote to them indicating that they should not have charged me a commission because in the past Datek did not charge me for partially filled orders and that as far as I know Datek has not changed that policy. Here's one their responses follows by a copy of a confirmation from Datek which clearly contradicts their response:

In your previous experience, you were probably not charged a commission fee due to our 60 second guarantee, not because we have a policy of not charging partial fills...
