On the issue of whether Clinton committed perjury both before the GJ and in the deposition over the issue of touching, let me correct a false impression I may have given. I think Clinton probably did lie about this, on a more likely than not standard. I think in an actual jury trial, he might well win on a beyond reasonable doubt standard, which is what I had in mind.

In fact that standard, in all its operation (including certainly unanimity), will not obtain in the Senate. So I think Clinton is likely to be considered guilty on that single count at least, in the two forums. Civil deposition and GJ testimony.

I continue to think that not enough to amount to a high crime, under all the circumstances.

Doug, Clinton read from a prepared statement the 1996 start date of his inappropriate relationship. So not only did he lie about the date to avoid the appearance he was doing her when she was an intern, he wrote it down and handed it to the IC. As a lawyer, you know there is no obligation for the IC to re-examine a date that was volunteered and well thought out in advance. In other words, the president cannot claim a memory mistake on it. That is cut and dried lying. Whether it is perjury rests on it relevance.

And thank you for admitting he lied about the touching. I was beginning to wonder about you. :-)
