Of course Datek doesn't guarantee 60 second fills on short sales. Short sales have no priority in the market. The fill time on these is always variable depending on downtick/uptick and the flow of sell orders from those who actually own the stock.

As for working time, that seems like a completely arbitrary caveat that Datek can use anytime they want to avoid making good on the guarantee. But the fact is they have made good on it most of the times I've requested it, working time or not. Besides, who else offers free commissions under similar circumstances.

Oh, and to save you some frustration the next time you try to get a commission reversed, they also don't apply the guarantee to NYSE trades before 10:00 AM.
