If 3dfx already told all the institutional investors before hand there would not be a need for the conference call on the day after that Chip reported.

STB, for example, is in the habit of doing things just the opposite. They tell the institutions and then put out a press release. It's common in the industry. If you are a long term investor it can actually be a good thing as it builds trust between the institutions and 3dfx.

Anyway, the descent to the depths of hell started way before anyone knew there was going to be a problem with the quarter.

Would have, could have, should have. First of all, this "setback" we are talking about is a difference of over $0.50/share, and a significant LOSS instead of a huge profit. I don't know how 3Dfx can be so numbskulled as to make these erroneous predictions about their own company, but there were some legitimate reasons for the shortfall - remember Diamond gave them a right good poking. The chip sector stinks rotten, and we're in it. There are plenty of explanations for our drop and call me a lemming but I'm willing to believe them. Occam's Razor.

I'd also recommend you speak with a lawyer before you even consider this lawsuit, if you are indeed seriously considering it. If you're just blowing off steam .. my apologies for taking it with such gravity.

And finally, as a shareholder of the company I think your proposed class action suit will only harm the company and consequently its investors - US. I for one don't want to see the share price plunge further because of a vengeful investor.
