Doug, my understanding is that Thomas has voted against Scalia twice. This was a Harper's index statistic, I'm sure a source was given but nothing easily accessible. Who knows, it may be three times by now. Scalia is widely considered brilliant, but he sure sounds mean. I haven't heard Thomas called brilliant.

The unfortunate part about the Thomas hearings is that he no doubt left them deeply embittered, but on the other hand spending 10 years as a lonely black in the Reagan/Bush Adms. must have had its own bitter elements. Those guys seemed to pride themselves on anti-political correctness.

It would take too long to detail his voting record. You can take a look at a ruling he made on Texas prison inmates getting beaten by guards that was way over the line and he sided with the guards; he would like to turn this country into China I guess.

He has done everything he can from his position to dismantle all the gains made by Marshall. There is a racial problem in this country and Blacks are correct about economic empowerment being the answer. To me, the helping to build a strong and sustaining Black middle class is the key to racial incorporating of Blacks fully into the fabric of our country. There were terrible wrongs done in the past and there has been a handcap that has been slowly overcome. Helping Blacks get into higher education and better jobs in the long run is good for everyone including Whites. Thomas benefited from programs that made him who he is, and I think to declare that he pulled himself up by the bootstraps and then rules to get rid of aid for anyone after him selfish at a minimum. You have to ask yourself what kind of character this guy is? I agree that racial blindness is important eventually, but we just ended the Civil War in 1964 and 1965 with the Civil Rights Act and the Voter's Rights Acts. Enforcement of those acts to the fullest have been the key landmarks of ending Aparteid in America. They are the key to the protections of not just Blacks, but anyone dealing with racial issues in the institutions of our country. The courts have been a force from these acts to make the progress we have seen possible. Weaken them, and you can make a case we just slowly slide back to the old system. I don't want that.
