Re the preferred, you can be sure that no contract can be breached. Prior posters who declared their "knowledge" about what was going on never supported themselves with evidence, reasons, or even explanations. Apparently, their idea of a news source is their imaginations, which is not inconsistent with most stock-board "information" or even typical office or factory-floor rumors.
