Dave, 3G-W-CDMA-VW-SETI is a total pipedream without some knowhow to make it work. Qualcomm owns the knowhow. cdma2000 can be built with the property Qualcomm has access to. Therefore it is not a pipe dream.

If Qualcomm doesn't give permission for their property to be used in the L M Ericsson idea, then it is as dead as a dodo.

Qualcomm can go to a USA court, show the patents and get an injunction if the case is crystal clear. Lawyers love to obfuscate, but some things really are quite simple. Armed with an injunction, L M Ericsson's USA property will be up for confiscation by USA bailiffs, police, marines or whatever is needed.

European governments will support the injunction or face a trade problem. Or maybe even a military problem!

Cases do not all take 5 years.

You wonder which standard has the greater market share? GSM. But so what. You don't put horseshoes on cars because horseshoes have greater market share when tyres have just been invented. Qualcomm will do what is best for Qualcomm. If the GSM conversion market is attractive for cdma2000 overlay or cdmaOne overlay, then Qualcomm will produce the necessary equipment and overlay European GSM systems. It's all a question of economics.
