Dave, past results do indicate future success. That is about all that does indicate future success. In any field whatsoever. Weren't you a lawyer? In which case you will have heard of precedent. There are laws written so that future decisions are based on previous ideas. Admittedly judges and lawyers are much more human than they think, so they can make quite wonky decisions at times, needing appeal processes. Actually, I think they are much less human than they think. Along with most of us!

What do you mean 'anything could/can happen in court'? That is simply wrong. It assumes that the subject falls in a grey area, in which case yes, a decision could go in various directions. Some things are not in doubt. Unanimous decisions can occur.

People hire patent lawyers to sort out how secure property is and whether a legal challenge is justified. The concept that people can capriciously set up court challenges is false. Do you not have "vexatious litigants" who simply get told they have no prima facie case and get biffed out of court by the bailiffs?
