Apparently, there was no crime committed by the bystander. You are not under any obligation to prevent someone from committing a crime. If you don't actively assist (act as a lookout, drive the getaway car, etc.) you aren't aiding or abetting. Some states have good samaritan laws, but Nevada (and California) doesn't.

No judge would allow a person to be held for no reason. You could always hold him for, say 48 hours (or whatever that jurisdiction would allow) without bringing charges, but the judge would let him loose at the arraignment. Of course, then the county would be subject to a flase arrest charge, since they knew very well the guy had not broken a law.

He may be scum, but he didn't break the law. Sounds familiar doesn't it <g>?
