The fact that the partners took the proposal to Intel before approaching the PCI SIG argues that they were sensitive to the arguments you propose, and intend to avoid the appearance of exclusion. Barrett's comments about this being targeted at Dell are a little strange in that context. I would expect that these companies would now do their best to drive the technology to market as quickly as possible to take advantage of their in-house silicon capability, knowing Intel will eventually make this capability available to everyone through standard chipsets.

One effect of the FTC and DOJ investigations has been to make all of the big players more aware of where the boundaries are. In that sense I think it has been a worthwhile exercise.
