I am not privvy to what may have been said in the first hearing, but I do remember a good old Federal Judge making the statement in open court that, from personal experience, he considered liquidated damages to be nothing less than penalties couched in legalese. The settlement offer from the defendant dropped from 1.2MM to 50K within the next ten minutes. I eventually only settled for 100K ... and considered myself lucky at that.

As to his being had, if that is the case, IMHO, he should recuse himself from the case, as objectivity would seem difficult to maintain under those circumstances.
