Instead, we simply hold that the absence of an element of claim 83 in the alleged infringing Mitsubishi device precludes a finding of equivalent infringement as a matter of law. So much for the theory of intermitent infringement:-( News does not seem to have affected this puppy drastically, as most probably thought that going up on appeal against Mitsu was a loooooooooooooooong shot anyway. With this distraction now out of the way, Ampex is now going to have to pull itself out of this mess on its own sans any windfall royalties from PIP at least. Lets hope Micronet starts to help soon.
