You might be right. I have some background in criminal law, and threw in the jury comment as an aside. Someone else in the thread said something about a jury also, in the context of complex technology being too much for it.

I'm sure someone will pipe up with the definitive answer.

I have the same dim recollection that patent trials are judge only trials. Not positive, however.
