Ailouros cannot acquire 1 share of stock without REFR's permission. REFR determines the floor and REFR can back out of the deal at anytime. They were able to write this on their own terms. Evidently you do not know the principals involved. I do. You have every right to short the stock but your information is faulty and you are evidently not aware of what is happening at the company. Ailorous is not interested in 8% when 500% is around the corner.

As I said in my prior post, we have a very sophisticated and knowledgeable investor base. They are not selling so the shorting and trading of shares provides the only liquidity we have. That will allow many to double their positions before product announcement. As I said it may turn out to be a good thing for us.
