IMHO, the problem with the definitions is that they are based first on English Common Law, and second on whatever adaptation was necessary to move away from English law to our Constitutional law. T

he framers left the wording deliberately vague, knowing that the indictment phase would be partisan, and hoping the trial phase would not be. Of course, the Senators were not supposed to be elected directly by the people either. The founders actually expected the Senators to be appointed by the state legislatures, and were supposed to be the people that were most likely to have the best interests of the country at heart, not their parties interests. Oh well, it was a nice thought.
