bp, not true. Shorting against-the-box was restricted last year by new Federal laws. Under the old rule, you could leave a short position open indefinitely. Now, you must close the positions by 12/31 of the year in which the stock was shorted. This forces you to take any income off of this transaction as short term gains.

You can thank the White House for that lovely change.
