flies in the face of the historical record in regards to the creation of the process itself, as well as 200 years of application.

I would suggest that sufficiently abhorent private behavior would manifest itself in public duties constituting a threat to the nation as a whole. Absent that tie, the Framers erred on the side of caution in regards to the long term viability of the system rather than individual and episodic abuses which would violate the aforementioned conjunction.

The Framers deemed this risk less than the politization of private conduct, a slippery slope which they understood all to well. Harken back to when this nation was founded. People fleeing both political and religious persecution. By including non-effecting private conduct, one risks the intended and supposedly co-equal strength of the executive to political power and the fashion of the day.

The Bill of Rights was added because it was recognized that adequate protection had not been included in the Constitution from the tyranny of the majority, a majority which could change quickly.
