Not in Canada, and probably not in the States. You could however sell UTEK, and buy something else that you may think has equally good prospects. e.g. NVLS, ASYT, PRIA, ... Anything involving keeping your UTEK shares or the right to buy those UTEK shares is likely to get you into tax difficulty should the IRS discover what you've done. So why screw around? There are numerous alternatives acceptable to the IRS, that should also be equally acceptable to you.

re:options in order to take take loss and avoid wash sale. I believe this is not allowed and is a violation of the wash sale rule.
