Wireless, here's some interesting things about this "major" news release we had yesterday in announcing the letter of intent to buy Marald Inc.

Firstof all they have a website at:
unlimitedcoatings.com
It was last updated Jan, 1998.

According to the Internic the Administrative contact is Carlos Martinez. They got the domain name June, last year. The address for the company is:
Unlimited Coatings
127-A Wilson Road
Humble, TX 77338

Looking at the Press Release I see they mention a spray on truck liner called "Toro Liner". Strange I just can't find any reference to this product elsewhere. Maybe you could take a crack at finding this product mentioned anywhere.

The other claim made by the Press Release was that they were the "third largest" spray on truck liner company. (#reply-5951790) It also states that they operate through a rapidly expanding network of approximately 70 independent distributors.

Well I am surely interested in how they make this unsubstantiated claim and how they measured. I did find this from Bullhide, however:
Spray Applied Liners ~
Our market research shows that there are only two major competitors. Bullhide has 40% higher physical properties and much more advanced application equipment than these competitors. The rest of the market is fragmented between several start-up companies, all of whom have either an inferior product and/or application equipment and techniques. Combined, all spray application competitors have captured no more than 5% of the new truck market and a very minimal part (less than 1%) of the used truck market.

And then I came across this from Rhino Linings:
Rhino Linings, of San Diego, CA, began in the spray-on truck liner business about eight years ago. They call their current dealership network, which totals 200+ worldwide, the largest in the U.S. for their type of product line. Lou Frank, vice-president of marketing, said that their dealers have had great success with sweeper hoppers.

Also mentioned at the same link this about Ziebart International:
"Or a Ziebart franchise dealer can put on almost the same product. There are 300 who will quote a price for the total job. The amount of prep work needed will affect the cost."

Outside of their own site I find no real reference to Unlimited Coatings, other than a couple of trade show appearances last year. Yet they say they are third largest in this field. Hmmmmm, something doesn't seem quite right.

Wireless, I have found out why I can't seem to find any references to Toro Liners.

. . . the Company's products are marketed under the "TORO LINER" name,. . .

I checked with the US Office of Trademarks and Patents, and guess what - Toro Liner has not been trademarked. An interesting factoid for a company that is the "third largest spray on truck bed liner" company either in a)the world, b) the US, c)the Southwest, d)Texas, e)Southeastern Texas, f)Harris County, g)Northeastern Harris County, h)Humble TX, or i)Wilson Road in Humble TX.

But then I checked a little deeper and wouldn't you know it the word Toro itself is already trademarked by some "obscure" company in Minnesota that makes lawnmowers and such. But as luck would have it they have been using the word Toro in International Class 012 since 1941.

International Class 012
Goods and Services TRUCKS; DATE OF FIRST USE: 1941.00.00; DATE OF FIRST USE IN COMMERCE: 1941.00.00

trademarks.uspto.gov

Just to double check to see if there might be any confusion in the market place in this Class 012, I looked at Ziebart. Wouldn't you know that their Truck Liners are registered in 012.

International Class 012
Goods and Services TRUCK BEDLINERS, SUNROOFS, SPLASH GUARDS, PROTECTIVE MOLDINGS, RUNNING BOARDS, TRUCK PASS-THROUGH WINDOWS, BUG DEFLECTORS; DATE OF FIRST USE: 1977.02.00; DATE OF FIRST USE IN COMMERCE: 1977.02.00

trademarks.uspto.gov

Seems like a funny position for a company that is the "third largest" in any of the markets a) thru i), to be selling a product using the word Toro that is already claimed by another company. I suppose Toro Manufacturing should be alerted.
