AFC Announces Litigation Victory Over Acer Netxus, Inc.

PETALUMA, Calif., Oct. 9 /PRNewswire/ -- Advanced Fibre Communications(R), Inc. (AFC) AFCI announced today that is has favorably resolved its two-year litigation dispute with Taiwan-based Acer Netxus, Inc.

Through a federal court complaint filed in September, 1996, and related arbitration proceedings, AFC had charged Acer Netxus with trade secret misappropriation and other legal violations arising from Acer Netxus' manufacture and sale of its AXC-2000 and AXS-3000 digital loop carrier systems.

On the eve of a scheduled arbitration trial, Acer Netxus agreed to terminate its development, manufacture and sale of these two systems, and to entry of a federal court permanent injunction. On September 22, 1998, the United States District Court, Northern District of California, entered a Permanent Injunction And Final Judgment in favor of AFC that:

1. Enjoins Acer Netxus from selling any digital loop carrier system for at least one year;

2. Permanently enjoins Acer Netxus from developing, manufacturing, or selling any device that uses or derives from UMC 1000 technology, including its AXC-2000 and AXS-3000 systems;

3. Requires that Acer Netxus destroy all work product and inventory related to the AXC-2000 and AXS-3000 systems; and

4. Permanently enjoins Acer Netxus from developing, manufacturing, or selling any digital loop carrier product, except one that is the product of strict clean room development or based on licensed third party technology not derived from AFC's UMC 1000.
