By treating daytrading as a business wouldn't that mean you would be subject to social security tax being "self employed"?

Actually, no. From the thread called "IRS, Tax related strategies--Traders": Subject 5727

(Post 511) "At first this was unclear. Congress put a technical correction in the recent tax legislation clarifying that even though the income becomes ordinary income, it doesn't become the type of income that's subject to self-employment tax." This is a helpful thread, albeit with few posts, and I recommend it.
