re:1. That's the one. Yes, they went the accepted route.
3. The 5% is deminimus if it has run up 50%..some houses charge double that for commissions. If a person is investing, rather that day trading or pure speculation, they wouldn't be affected anyway.
4. Interesting news about Instinet, will have to read up.
5. It would be preferable if they focused on the large houses first, with teeth to their prosecution. xref Mer. Lyn. does Orange County. And many, many more. I don't have much hope for that ...the sec doesn't have enough money to fight their lawyers.
