Spoke to someone who was at the Supreme Court argument. His read of the argument was that it went very well for the CLECs and very badly for the BOCs and GTE. There were two central issues of the case: the FCC's authority to issue pricing rules, and the FCC's unbundling rules. The Justices indicated that they were leaning toward reinstating the FCC pricing regulations, which will be very important for the CLECs like AT&T and Worldcom to get their entry strategy back on track. On the second issue, unbundling, the Justices didn't appear to show their hand. That is mostly because GTE's lawyer who argued for ILECs was all over the map in his argument and he wasted his time on irrelevant issues.
