About the only thing that we agree on is that the Q's IPR will not be "proven" to apply to broadband wireless unless it's challenged in court.

Good, I am glad that we can agree on something. Can we also agree that the court system interprets the claims more narrowly than in examination?

With respect to the patent and flow rates, however, what if the competitor with the higher flow rates make modifications to the hose and then patents the modifications?

I would be interested in the filing dates of these patents (not to mention the substance) which is something considered very strongly in IPR cases.

The US is first to invent and reduce to practice. Filing dates are important, but are extremely important in the rest of the world. Remember Interference practice?

LIke I have said before, there are many different platforms of computers, i.e. IBM Compat., Digital Alpha, Sun Workstations, Silicon Graphics....
