Lamarr asks for speedy judgment in Corel suit

LONGWOOD -- U.S. District Judge Patricia C. Fawsett has agreed to study retired actress Hedy Lamarr's motion for a summary judgment and a preliminary injunction against Canadian software giant Corel Corp. and The McGraw-Hill Cos. of New York.

Fawsett has scheduled an Oct. 29 morning hearing on the injunction issue but will rule on the summary judgment motion in her private chambers Oct. 26.

The judge's Sept. 28 announcements followed Lamarr's filing of an affidavit for the first time in the 8-month-old invasion of privacy suit.

The affidavit states the one-time Hollywood siren sued the defendants Feb. 6, 1998, for $5 million only after they "refused to discontinue the use of my name and likeness" on computer software packages and publications.

The 83-year-old actress, who has lived alone in Longwood for the past 10 years, states Corel and McGraw-Hill "continue to re-publish and re-use my name and likeness in connection with additional products and marketing efforts."

Corel argues it technically has Lamarr's permission to use her photo and name through graphic artist John Corkery. The artist allegedly obtained Lamarr's OK before he won a $250,000 Corel-sponsored competition in Ottawa in 1996.

Lamarr previously offered to settle the suit with Corel for $250,000, but the company declined. McGraw-Hill hadn't answered the suit as of Oct. 12.
