Chaz, forget the blocking bologna. As Gregg Powers told us last week, we now all know who was full of bull poo-poo the whole time. JGoren is right, settlement and licensing agreement are just around the corner.

I have said, from the beginning, that it was highly unlikely the case would ever go to trial and that the case would settle and there would be some agreement, including Ericy license. That looks like a highly probable scenario at this point. From a strategic standpoint, I would think the Ericy forces are in disarray with most of their case being conceded. Presumably, Ericy is left with its strongest 3 claims; from its point of view, it would argue it is "strengthening" its case by concentrating on its best 3 patent claims. From Qcom's point of view it shows weakness. Without knowing which patents are left and the nature of the Ericy claims, there is no way to tell whether the remaining three claims are really strong, are potentially blocking. or whether they are merely "colorable" claims, where there is maybe just enough to maintain a case--but not realistically winnable. Only time will tell, but I don't tbink we shall ever know. I think Gregg Powers is correct in speculating that Ericy is about ready to cave in and is preparing to "blame it all" on Qcom.
