Why should the Supreme Court agree to hear it? If the unfriendly Jackson listens to the facts he will have to decide in favor of MSFT (look at today's examination of Barksdale;NSCP was"guilty"of the same crime) any government appeal will fall on deaf ears at the Appellate Level. Remember the govt. (that's us - I can't believe it) has lost once there already on similar grounds.

If Jackson goes on auto pilot and rules by habit against MSFT then the Appeals Court will side with MSFT and once again embarrass Jackson. The Supreme Court will refuse to review the lower Appeals Court decision and will let it stand not wishing to be tainted by this political circus.
