Jeff:

As you and others have implied - sucks to be them right now.

I wouldn't want to be in Ericsson shoes, it will be an uphill battle.

With respect to Ericsson weakening their hand, as JGoren stated, in Ericsson's point of view, the could have strengthened their case by focusing only on 3 patents. Of course, in any suit, one throws everything and anything at the opposing party, hoping for something to "stick"

Dave re "To charge off and claim infringement in 11 areas and then 2 years later, as the trial date draws near, to say 'oh uh, forget 8 of those.' is weak to be sure."

This shows the irrelevance of how many patents are issued. You have previously quoted numbers of patents as being significant. Patents are not a democratic process where you count them up and the one with the most wins. Same with SETI voting system - they call it democratic which is an abuse of the word. I think the Catholics and Chinese vote for their leaders too, but nobody mistakes them for democratic.

I suppose numbers of patents issued might be a shorthand way of seeing whether somebody is at least active in the field, but that's about it. Maybe one of the remaining L M Ericsson claims will be significant. Don't bet on it!

Oh, new post, one back - L M E isn't just giving up at all. They own the lot now. IS95, cdma2000, the SETI system. Despite years of saying IS-95 couldn't and wouldn't work. Saying they'd deny customers cdma etc. Which of them do we believe?
